ORDER ACCEPTANCE POLICY
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. GolfTournament.com reserves the right at any time after receipt of your order to accept or decline your order for any reason.
CREDIT CARDS
We accept the following credit cards: Visa, MasterCard, American Express and Discover. There is no surcharge for using your credit card to make purchases. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order. Your credit card will be billed at checkout.
CHECKS
We accept money orders, cashier’s checks, personal checks, and company checks in U.S. Dollars only. Orders are processed upon receipt of a money order or cashier’s check. For personal and company checks, please allow up to 10 banking days after receipt for clearance of funds before the order is processed. We cannot guarantee the availability of a product by the time funds clear or payment is received. We will charge a $25 fee on all returned checks.
SHIPPING POLICY
Standard Shipping Method: All orders will ship via UPS Ground or FedEx Ground unless otherwise requested.
Expedited Shipping Methods: We offer several methods to expedite shipping including UPS Next Day Air, UPS Next Day Air Saver, UPS 2nd Day Air, and UPS 3 Day Select as well as FedEx Standard Overnight, FedEx 2 Day, and FedEx Express Saver. Alternative UPS and FedEx methods are available upon request. United States Postal Service are also available upon request.
Shipping Time: Most blank apparel orders received before 2:00 PM CST will ship the same day, provided the product ordered is in stock. Most blank apparel orders received after 2:00 PM CST will ship the next business day. Custom orders require various lead times and ship dates. Orders are not processed or shipped on Saturday or Sunday, except by prior arrangement.
We cannot guarantee when an order will arrive. Consider any shipping or transit time offered to you by GolfTournament.com as an estimate based on published shipper guidelines. We cannot be held responsible for weather delays, etc. We encourage you to order in a timely fashion to avoid delays caused by shipping or product availability.
OUT OF STOCK & BACK ORDERED PRODUCTS
We will ship your product as it becomes available. Usually, blank products ship the same day if ordered by 2:00PM CST , or by the next business day if your order is received after this time and for orders received on Saturday, Sunday or any major holiday. Custom orders require more lead time with ship dates based upon the item. There may be times when the product you have ordered is out-of-stock which will delay fulfilling your order. We will keep you informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment. You may cancel your order at any time prior to shipping.
MULTIPLE PRODUCT ORDERS
For a multiple product order, we will make every attempt to ship all products contained in the order at the same time. Products that are unavailable at the time of shipping will be shipped as they become available, unless you inform us otherwise. You will only be charged for products contained in a given shipment, plus any applicable shipping charges. You will only be charged for shipping at the rate quoted to you on your purchase receipt. The entirety of this shipping charge may be applied to the first product(s) shipped on a multiple shipment order.
RUSH ORDERS
Standard production time varies for each product. On average, standard production times run 7-10 business days for most products, however there are exceptions. Rush production service is available on many products for an additional fee. Please call for pricing.
TAXES
GolfTournament.com shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the states of Texas and Arkansas. For orders shipped to other states, you are solely responsible for all sales taxes or other taxes.
RETURNS
We will gladly accept the return of products that are defective due to defects in manufacturing and/or workmanship for 30 days from the date of purchase. Fulfillment mistakes that we make resulting in the shipment of incorrect product to you will also be accepted for return 30 days from the date of purchase.
TYPOGRAPHICAL ERRORS
In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, GolfTournament.com shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. GolfTournament.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, GolfTournament.com shall immediately issue a credit to your credit card account in the amount of the incorrect price.

CALIFORNIA PROP 65 COMPLIANCE
ll products shipped by GolfTournament.com and third party suppliers/manufacturers of GolfTournament.com into the State of California are subject to Proposition 65 (“Prop 65”) or The Safe Drinking Water and Toxic Enforcement Act of 1986. "Prop 65" was created through the ballot initiative process and was intended to protect California citizens and the State’s drinking water from a State determined list of over 900 chemicals that are “known” by the State to cause cancer, reproductive harm, or birth defects. This list and other information regarding Prop 65 can be accessed at http://www.oehha.ca.gov/prop65.
Prop 65 requires that a “clear and reasonable warning” be provided by a Person/Company in the course of doing business, who manufactures, produces, assembles, processes, handles, distributes, stores, sells, or otherwise transfers a consumer product which he or she knows to contain a chemical known to the state to cause cancer or reproductive toxicity to any person to whom the product is sold or transferred.
The lead state agency handling Proposition 65, the Office of Environmental Health Hazard Assessment (OEHHA ; www.oehha.ca.gov), has established safe harbor levels which include No Significant Risk Levels (NSRLs) for cancer-causing chemicals and Maximum Allowable Dose Levels (MADLs) for chemicals causing reproductive toxicity for many of the 900 chemicals listed under Proposition 65. Exposure levels and discharges to drinking water sources that are below the safe harbor levels are exempt from the requirements of Proposition 65. A document that provides the status of OEHHA’s adoption or development of NSRLs and MADLs is available below.
For chemicals that do not have published or established safe harbor levels, the burden is on the defendant to establish an appropriate MADDL or NSRL, and to show that the exposures in its products do not exceed these levels. For exposures to consumer products, such as promotional items, the level of exposure to the listed chemical is calculated using the "reasonably anticipated rate of intake or exposure for average users of the consumer product.
Companies are becoming increasingly vulnerable to lawsuits for Proposition 65 indiscretions. According to the 2016 California Proposition 65 Enforcement Report, there were 760 settlements, with a total cost of roughly $57 million. Proposition 65 may be enforced by the California Attorney General, public enforcers such as district attorneys, and private plaintiffs suing in the public interest (after they have first served a 60- day notice of violation on all public prosecutors and no public prosecutor proceeds to enforce the alleged violation. A plaintiff may seek injunctive relief as well as penalties of $2,500 per violation per day. A more general California statute allows most successful plaintiffs to recover their attorneys' fees as well. It is important to note the very long reach of Proposition 65 liability. One need not be doing business in California to be in the chain of Proposition 65 litigation. Indeed, you could be a New Jersey distributor of products sold to you by a Massachusetts supplier, and your client could be doing business in New York, with no California affiliation. Should one of the items you sold to your client end up in California, you and your supplier and your client could be named as defendants in a Proposition 65 lawsuit, and the venue would be in California.

If so, then the best option to ensure compliance is to include a label on each product that may ship to the State of California which we will do free of charge upon request.
